Interlibrary Loan Copyright Guidelines

The copyright law of of the United States (Title 17, United States Code) [1]governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or reproduction is not to be "used for any purpose other than the private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy, or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement. This supplier reserves the right to refuse to accept a copying order, if in its judgement, fulfillment of the order would involve violation of copyright law.

The Copyright Law further requires us to keep a record of all materials ordered for five years. We must report anything beyond five copies out of one publication in a year's time, if it has occurred within the past five years, to the Copyright Clearance Center (CCC) to gain permission for and pay fees for the use of these materials. If we cannot obtain permission from the CCC, the request is denied.
